SwingRides Terms & Conditions of Use

Welcome to SwingRides. These Terms & Conditions ("Terms") govern your access to and use of the SwingRides website, mobile applications, software, services, and related products (collectively, the "Platform").

By creating an account, accessing, or using the platform, you agree to these terms.

If you do not agree, you may not use the Platform.

1. Definitions

SwingRidesmeans the technology platform that provides software and management tools for independent vehicle rental businesses.

Hostmeans an individual or business that registers with SwingRides to advertise, manage, and rent vehicles.

Guest (Renter)means a user who searches for, books, or rents vehicles from a Host.

Bookingmeans a reservation made between a Guest and a Host through the Platform.

Platformmeans the SwingRides website, applications, dashboards, APIs, and related services.

2. Our Role

SwingRides provides technology services only.

SwingRides:

  • Does not own vehicles.
  • Does not operate rental businesses.
  • Does not employ Hosts.
  • Does not guarantee vehicle availability.
  • Does not collect rental payments on behalf of Hosts (unless future services expressly state otherwise).
  • Is not a party to any rental agreement.

Every rental contract exists solely between the Host and the Guest.

3. Eligibility

Users must:

  • Be at least 18 years old (or the legal age in their jurisdiction).
  • Possess legal authority to enter contracts.
  • Provide accurate information.
  • Maintain current account information.

Hosts may be required to complete business verification before listing vehicles.

4. User Accounts

Users agree to:

  • Keep passwords secure.
  • Maintain accurate information.
  • Promptly notify SwingRides of unauthorized access.
  • Be responsible for all activity under their account.

SwingRides may suspend or terminate accounts suspected of fraud or misuse.

5. Host Responsibilities

Hosts agree to:

  • Maintain all required licenses and registrations.
  • Ensure vehicles are roadworthy.
  • Maintain legally required insurance.
  • Accurately describe vehicles.
  • Clearly disclose rental terms.
  • Honor confirmed bookings unless prevented by circumstances beyond their control.
  • Respond to guests professionally.
  • Comply with applicable laws.

Hosts remain solely responsible for:

  • Vehicle safety
  • Pricing
  • Rental agreements
  • Taxes
  • Insurance
  • Regulatory compliance

6. Guest Responsibilities

Guests agree to:

  • Provide accurate information.
  • Maintain a valid driver's license.
  • Follow the Host's rental agreement.
  • Return vehicles on time.
  • Operate vehicles legally.
  • Report accidents immediately.
  • Pay all agreed rental charges directly to the Host.

Guests are responsible for damages caused through negligence or violations of applicable laws or rental agreements.

7. Business Verification

SwingRides may verify the following:

  • Business registration
  • Identity
  • Contact information
  • Licensing
  • Insurance documentation

Verification does not constitute an endorsement or guarantee of a Host's business.

8. Vehicle Listings

Hosts are responsible for ensuring that listings accurately describe:

  • Vehicle specifications
  • Availability
  • Pricing
  • Restrictions
  • Fees
  • Insurance requirements

SwingRides reserves the right to remove inaccurate or misleading listings.

9. Payments

At launch:

All rental payments occur directly between the Host and Guest.

SwingRides is not responsible for:

  • Collecting payments
  • Refunds
  • Chargebacks
  • Payment disputes
  • Deposits

Future payment services will be governed by separate terms.

10. Insurance

Insurance requirements vary by Host.

Hosts are responsible for clearly disclosing:

  • Insurance provider
  • Coverage limits
  • Deductibles
  • Guest responsibilities

Guests are responsible for understanding applicable insurance before accepting a rental agreement.

SwingRides does not provide insurance coverage unless expressly stated.

11. Cancellations

Cancellation policies are established by each Host.

Guests should review the Host's cancellation policy before booking.

SwingRides may assist with communication but does not determine refund eligibility.

12. Vehicle Condition

Hosts should provide vehicles in safe operating condition.

Guests should inspect vehicles before driving.

Any existing damage should be documented before the rental begins.

13. Accidents

If an accident occurs:

  • Contact emergency services if necessary.
  • Notify the Host immediately.
  • Follow insurance procedures.
  • Submit a report through SwingRides if required.

SwingRides does not investigate accidents or determine liability.

14. Prohibited Activities

Users may not:

  • Submit false information.
  • Create fraudulent bookings.
  • Circumvent subscription fees.
  • Use stolen identities.
  • Interfere with Platform operations.
  • Upload malicious software.
  • Harass other users.
  • Misrepresent businesses.
  • Rent vehicles illegally.
  • Attempt unauthorized access.

Violation may result in immediate account suspension.

15. Reviews

Users may submit honest reviews.

Reviews may not include:

  • False statements
  • Hate speech
  • Threats
  • Confidential information
  • Illegal content

SwingRides reserves the right to remove reviews violating these standards.

16. Intellectual Property

The platform, software, branding, trademarks, graphics, documentation, and content remain the exclusive property of SwingRides.

Users receive a limited, non-transferable license to use the Platform.

17. Privacy

Use of the Platform is governed by the SwingRides Privacy Policy.

By using the Platform, users consent to the collection and processing of information necessary to provide services.

18. Electronic Communications

Users consent to receive:

  • Emails
  • SMS messages
  • Push notifications
  • System alerts

Users may manage communication preferences where permitted.

19. Platform Availability

SwingRides strives for high availability but does not guarantee uninterrupted service.

Maintenance, upgrades, outages, or circumstances beyond our control may temporarily affect availability.

20. Third-Party Services

The Platform may integrate with:

  • SMS providers
  • Email providers
  • Insurance companies
  • Accounting software
  • Payment processors
  • Mapping services

SwingRides is not responsible for third-party services.

21. Subscription Services

Hosts subscribe to access the platform.

Subscriptions:

  • Renew according to the selected billing cycle unless canceled.
  • May be upgraded or downgraded.
  • Are subject to applicable pricing at renewal.

Failure to pay subscription fees may result in account suspension.

22. White-Label Services

Hosts using SwingRides’ white-label websites remain responsible for:

  • Website content
  • Business policies
  • Pricing
  • Customer interactions
  • Legal compliance

SwingRides provides the underlying technology only.

23. Limitation of Liability

To the fullest extent permitted by law:

SwingRides shall not be liable for:

  • Vehicle defects
  • Personal injury
  • Property damage
  • Lost profits
  • Business interruption
  • Insurance disputes
  • Payment disputes
  • Vehicle availability
  • Rental contract disputes

SwingRides' maximum liability shall not exceed the subscription fees paid by the Host during the preceding twelve (12) months or, for Guests, any fees paid directly to SwingRides (if applicable).

24. Indemnification

Users agree to defend, indemnify, and hold harmless SwingRides, its affiliates, officers, employees, and partners from claims arising from:

  • Violations of these Terms.
  • Negligence.
  • Fraud.
  • Misrepresentation.
  • Rental disputes.
  • Vehicle operation.
  • Violations of law.

25. Suspension and Termination

SwingRides may suspend or terminate accounts for:

  • Fraud
  • Illegal activity
  • Non-payment of subscriptions
  • Abuse of the Platform
  • Repeated policy violations
  • Security concerns

Termination does not affect obligations arising before termination.

26. Changes to These Terms

SwingRides may modify these Terms periodically.

Updated versions will be published on the platform.

Continued use constitutes acceptance of revised Terms.

27. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which the Host operates, unless otherwise required by applicable law.

For disputes involving SwingRides directly, the governing law and venue shall be those specified in SwingRides' corporate registration jurisdiction.

28. Dispute Resolution

Before initiating legal proceedings, users agree to make a good-faith effort to resolve disputes through written notice and informal negotiation.

If unresolved, disputes involving SwingRides may proceed to mediation or arbitration where permitted by law.

Disputes solely between Hosts and Guests remain the responsibility of those parties unless SwingRides elects to assist through its incident resolution process.

29. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

30. Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, applicable subscription terms, and any rental agreements between Hosts and Guests, constitute the entire agreement governing use of the Platform.
